Terms & Conditions

These terms are an agreement between you and Reel Lucky (ABN 18 614 133 179), a business operated as a sole trader in New South Wales, Australia (“Reel Lucky”, “we”, “us”). By creating an account or using reellucky.io you agree to them. If you don't agree, don't use the service. Questions any time: reellucky.hq@gmail.com.

1. What Reel Lucky is, and what it isn't

Reel Lucky is a fishing planning tool. You tell it when you're free, where you're based, how you fish and what you're chasing; it combines public weather, tide and swell data with curated local fishing knowledge and uses artificial intelligence to generate suggested plans.

2. Safety, risk warning and assumption of risk

RISK WARNING (including for the purposes of the Civil Liability Act 2002 (NSW) and equivalent laws): fishing (including rock fishing, boat fishing, kayak fishing and land-based fishing near water) is a dangerous recreational activity. It carries significant risks that include being swept from rocks by waves, drowning, capsize, hypothermia, serious injury and death. These risks are real even in apparently calm conditions, and they exist whether or not you follow a Reel Lucky plan.

By using Reel Lucky you acknowledge these risks and choose to fish at your own risk. You agree that our plans never override your own judgement, official warnings, local signage or the law, and that you are solely responsible for your decisions on and near the water, including the decision not to go.

You must comply with all safety laws that apply to you, including NSW lifejacket requirements for rock fishing in declared areas and for boating. Our Fishing Safety page explains the essentials. Read it. We may ask you to acknowledge it inside the app, and we keep a record of that acknowledgement.

The service (including its design, software, knowledge base and generated plans) is protected by intellectual property laws. Plans are licensed to you for your personal, non-commercial use.

8. Fishing rules and licences are your responsibility

You're responsible for holding a valid NSW recreational fishing licence where required, and for complying with bag limits, size limits, closed seasons, closures, marine-park rules and every other fisheries law. We try to reflect the rules but the authoritative source is NSW DPI Fisheries (dpi.nsw.gov.au).

9. Availability

We aim to keep Reel Lucky up and useful, but we don't promise uninterrupted or error-free operation. Features may change, be paused or be retired. Where a change materially reduces something you've paid for, our Refund Policy applies.

10. Liability

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.

To the maximum extent the law allows:

You agree to indemnify us against loss we suffer from your unlawful use of the service or your breach of these terms, except to the extent we caused the loss.

11. Ending the agreement

You can stop using Reel Lucky or delete your account at any time. We can suspend or terminate accounts as described in section 5. Sections that by their nature should survive (including 2, 6, 7 and 10) survive termination.

12. Changes to these terms

We may update these terms as the product evolves. For material changes we'll give notice in the app or by email before they take effect; continuing to use the service after that is acceptance. The current version always lives at reellucky.io/terms.

13. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
